Terms of Service

1. Scope
These Terms govern the use of the online service TCGScale (tcgscale.com), operated by Alexander Seibold ("Provider"). By using the service, the user agrees to these Terms.
2. Service description
TCGScale provides AI-based upscaling of trading card images to four times (4x) the original resolution. The service uses a credit system: 1 credit = 1 upscaled image.
3. Account and registration
An account is required. The user is responsible for keeping their credentials confidential. Upon registration, 3 free credits are granted.
4. Prices and payment
Prices for credit packages are stated in US dollars (USD) and shown on the purchase page. Payment is processed via Stripe. Purchases are one-time, not a subscription.
5. Right of withdrawal and waiver (EU consumers)
For digital services, any right of withdrawal expires once performance has begun, provided the user has expressly consented and acknowledged that they lose their right of withdrawal upon commencement. By purchasing and using credits, the user gives this express consent.
6. User obligations / copyright
The user warrants that they hold the necessary rights to the uploaded images or are otherwise authorized to have them processed. Uploading unlawful, infringing or offensive content is prohibited. The user indemnifies the Provider against third-party claims arising from a breach of these obligations.
Complaints regarding possible rights infringements can be sent to support@tcgscale.com; reported content will be reviewed and removed if necessary (notice-and-takedown).
7. Availability
The Provider strives for high availability but does not guarantee uninterrupted availability. Maintenance, faults or force majeure may temporarily limit the service.
8. Limitation of liability
The service is provided 'as is' without warranty of a specific result or image quality. To the extent permitted by law, the Provider's liability is limited to intent and gross negligence. Liability for indirect damages, data loss or lost profit is excluded.
9. Changes
The Provider may amend these Terms. The version published at the time of use applies.
10. Governing law and jurisdiction
Swiss law applies, excluding conflict-of-law rules. The place of jurisdiction is, to the extent permitted by law, the Provider's seat. Mandatory consumer protection provisions of the user's country of residence remain unaffected.
